Summary: Prohibits carriers that offer/issue a health plan that covers pharmaceutical services, including Rx drug coverage, from:
- limiting or restricting which pharmacy a covered individual chooses
- increasing or imposing copayments, fees or cost sharing for a pharmacy the covered person chooses.
- Denying a pharmacy/pharmacist the right to partake in any of its pharmacy network contracts or as a provider if they have a valid CO License and agrees to specified conditions
This would not apply to: pharmacy services administered to someone receiving inpatient or emergency medical care in a licensed health facility, a carrier that offers managed care plans and provides a majority of covered professional services through physicians employed by the carrier, a self-funded plan that is exempt from state regulation, or a plan issued for coverage for state/federal employees.
